Dutch Court Seeks Guidance On Unfair Contracts In Dexia Suit

Law360, London (August 20, 2019, 6:01 PM BST) -- A Dutch court handling a case involving a Dexia Banking Group unit has asked the European Union's highest court to clarify the extent to which banking customers can claim compensation for unfair terms in contracts now declared void.

A court in The Hague, has referred two questions to the European Court of Justice for a preliminary ruling. It wants to know whether a consumer seeking compensation for unfair contract terms can claim that redress through a supplementary legal process, even when the consumer didn’t meet its obligations under the original arrangement.
