Order on Motion to Approve
ORDER granting 103 Motion to Approve. IT IS HEREBY ORDERED pursuant to Local Rule 83.2(a) that the proposed settlement of this matter is approved, including the Settlement Agreement, the proposed attorneys' fees and costs to be paid to Plaintiff's Counsel, and the proposed distribution of any settlement payment. SO ORDERED. (Signed by Judge Ronnie Abrams on 8/7/2026) (ks)
Order
ORDER granting 102 Letter Motion to Seal. Application granted. Not only has the Second Circuit described the presumption of public access for settlement and related materials as "weak," Gambale v. Deutsche Bank AG, 377 F.3d 133, 144 ( 2d Cir. 2004), but given the highly confidential and sensitive health of other private information contained within the settlement agreement and related materials here, the Court agrees that sealing appropriate. See Gutierrez v. Dubois, 2020 WL 307 2242, *10 (S.D.N.Y. June 10, 2020) (sealing medication records because the "presumption of access is outweighed...by Petitioner's considerable privacy interest in his medical privacy interest in sensitive medical documents); Schoeps v. Mus eum of Modern Art, 603 F.Supp.273, 676 n.2 )S.D.N.Y. 2009)(collecting cases standing for the proposition that "the presumption of public access is weak when settlement confidentiality is concerned"). For the same reasons, the Court has also sealed the transcript of the hearing held today concerning the parties' joint motion for approval of the settlement agreement. SO ORDERED. (Signed by Judge Ronnie Abrams on 8/7/2026) (ks)
