Perry: Plaintiff has asked for permission to file a second amended complaint instanter 43 , presumably in lieu of responding to the pending motions to dismiss. Plaintiff claims that the proposed amended complaint is attached to his motion, but it is not. As there have been numerous IT issues with the Court's technology in the last several weeks, the Court credits Plaintiff's representations about technical issues preventing him from timely filing. However, Plaintiff must ensure a proposed second amended complaint is on the docket by 9/15/2026 so the Court can properly evaluate his motion.
