ORDER TO AMEND: The Court dismisses, under the probate exception to this court's subject matter jurisdiction, Plaintiff's claims in which he asks this Court to adjudicate whether he has a legal interest in the ownership of the residence due to the deaths of his relatives, for lack of subject matter jurisdiction. See Fed. R. Civ. P. 12(h)(3). Plaintiff is not permitted to replead these claims in a second amended complaint filed in this action.The Court dismisses Plaintiff's claims under 42 U.S.C. § 1983 against Defendants Tony DaCosta Greenidge and Belinda Nunez for failure to state a claim on which relief may be granted. See 28 U.S.C. § 1915(e)(2)(B)(ii). Plaintiff is not permitted to replead these claims in a second amended complaint filed in this action.The Court severs from this action, under Rule 21 of the Federal Rules of Civil Procedure, and dismisses without prejudice to litigation in a new separate civil action, Plaintiff's claims against Rhonald Hyndman; Brandi Hyndman; Cunningham; ABC Legal Services, LLC; and "ABC Intake, Quality-Control, and Proof-Revision John/Jane Does 1-10." The Court declines to direct the Clerk of Court to open such claims in new separate civil action. See Fed. R. Civ. P. 8(a). Plaintiff is not permitted to replead these claims in a second amended complaint filed in this action.The Court dismisses Plaintiff's remaining claims under Section 1983 against the County of Westchester; the City of New Rochelle; Zazzarino; Higginbotham; Gonzalez; the unidentified "Report-Creation and Evidence John/Jane Does 1-10"; the unidentified "Warrant, Notice, Dispatch, and Record John/Jane Does 1-20"; and the unidentified "County Custody and Administrative John/Jane Does 1-10" for failure to state a claim on which relief may be granted. See § 1915(e)(2)(B)(ii). The Court, however, grants Plaintiff leave to replead these claims in a second amended complaint, addressing the deficiencies specified above, within 30 days of the date of this order.If Plaintiff fails to file a second amended complaint within this time allowed, the Court will dismiss this action for the reasons set forth in this order. The additional effect of that dismissal will be that the Court declines to consider, under its supplemental jurisdiction, Plaintiff's remaining claims under state law. See 28 U.S.C. § 1367(c)(3).The Court denies Plaintiff's motion for leave to amend (ECF 44) as unnecessary.Because Plaintiff does not allege that he attended and completed the relevant training course, either in person or online, the Court denies Plaintiff's motion for permission for electronic case fling (ECF 6) without prejudice to his filing another such motion once he has completed that course. In light of the deficiencies in his amended complaint, and because Plaintiff's filing of an amended complaint appears to have mooted at least some of his pending motions and requests for relief, the Court denies all of Plaintiff's other pending motions and requests for relief.Accordingly, the Court directs the Clerk of Court to terminate ECF 6, 7, 9, 10, 11, 25, 28, 34, 44, and 50.The Court also directs the Clerk of Court to change the nature of suit ("NOS") code for this action to 550. The Court informs Plaintiff that this NOS code redesignation is merely for the purposes of the court's administrative filing records and has nothing to do with the Court's adjudication of the merits of his claims in this action; the fact that this action is redesignated with a "prisoner" NOS code is irrelevant to the merits of his claims.The Court certifies, under 28 U.S.C. § 1915(a)(3), that any appeal from this order would not be taken in good faith and, therefore, IFP status is denied for the purpose of an appeal. Cf. Coppedge v. United States, 369 U.S. 438, 444-45 (1962) (holding that an appellant demonstrates good faith when he seeks review of a nonfrivolous issue).SO ORDERED.
