ORDER. By August 6, 2026, Plaintiffs shall file a letter with the Court indicating whether they are interested in the possibility of being represented by pro bono counsel. "First, it is well-settled that, except when faced with the prospect of imprisonment, a litigant has no legal right to counsel in civil cases." Guggenheim Cap., LLC v. Birnbaum, 722 F.3d 444, 453 (2d Cir. 2013). The Sixth Amendment right to counsel applies only in criminal and quasi-criminal proceedings, and not to civil cases, see In re Martin-Trigona, 737 F.2d 1254, 1260 (2d Cir. 1984), and as such, the Court does not have the power to compel an attorney to represent Plaintiffs on a pro bono basis. Only if the Court is able to locate an attorney volunteer will counsel be appointed. If Plaintiffs seek to apply for representation by volunteer counsel, Plaintiffs shall complete the enclosed Long-Form IFP application and submit it with their letter on August 6, 2026.
