MINUTE ORDER signed by Magistrate Judge Christopher D. Baker on 02/24/2026: Pending before the Court is the parties' jointly executed stipulated dismissal of this action (Doc. 18 ) and their separate filing made at the Court's direction (see Doc. 19). In that separate filing, Plaintiff clarifies that the claim pleaded in the original complaint pursuant to the California Private Attorneys General Act ("PAGA") was not included in the operative first amended complaint because the claim was the subject of a prior settlement in a separate and unrelated state court action. See (Doc. 20 ). Under the circumstances, because Defendants have not filed an answer or motion for summary judgment, Plaintiff may dismiss this action without leave of the Court. See Fed. R. Civ. P. 41(a)(1)(A)(i). Accordingly, in light of the dismissal (Doc. 18), this action is terminated by operation of law without further order from the Court. See id. The Clerk of the Court is directed to adjust the docket to reflect dismissal with prejudice and to close this case. (Deputy Clerk CRB)
