Order on Motion to Adjourn Conference
ORDER granting in part and denying in part 19 Motion to Adjourn: Defendant's 19 request for "a 60-day adjournment of the current Motion for Judgment on the Pleadings briefing schedule" and for permission "to serve limited discovery requests on Plaintiff solely as to her communications with and written submissions to the Equal Employment Opportunity Commission ('EEOC') in relation to her Charge of Discrimination against Defendant" is granted in part. Letter from Defendant to the Court at 1 (July 23, 2026), Dkt. 19. At the initial conference held on June 25, 2026, Magistrate Judge Kuo granted the parties' request to stay discovery pending Defendant's anticipated motion for judgment on the pleadings, which was premised on Plaintiff's failure to timely filed her Charge of Discrimination within the 300-day limitations period. See Minute Entry, dated June 26, 2026; Letter from Defendant to the Court at 1-3 (June 15, 2026), Dkt. 14. However, on June 26, 2026, in response to Defendant's request for a pre-motion conference, Plaintiff asserted that she made efforts to timely initiate and pursue her EEOC claim. See Letter from Plaintiff to the Court at 1-2 (June 26, 2026), Dkt. 17. As a result, Defendant now seeks a 60-day adjournment of the briefing schedule and discovery to evaluate whether a motion for judgment on the pleadings is warranted "given Plaintiff's new allegations" and represents that "Plaintiff does not consent to Defendant's request for an adjournment and has not provided Defendant a reason for refusing consent." Letter from Defendant to the Court at 2 (July 23, 2026), Dkt. 19. The Court hereby vacates the briefing schedule and refers the issue of discovery to Magistrate Judge Kuo. Defendant is directed to submit its request for limited discovery to Magistrate Judge Kuo by August 6, 2026. Upon resolution of the discovery issue, to the extent that the record so warrants, Defendant shall take steps to initiate motion practice, consistent with this Court's Individual Practices and Rules.
