ORDER - Having reviewed PLAINTIFFS' NOTICE OF APPEAL FROM THE COURT'S DENIAL OF A PRELIMINARY INJUNCTION (the "Notice of Appeal") (ECFNo. 63 ), the Court finds that it is necessary for the parties to brief the extent to which, if any, that Plaintiffs' pending Noticeof Appeal divests this Court of jurisdiction to address the matters covered in the Motions for Summary Judgment (ECF Nos. 22 , 33 ) currently pending before the Court. In turn, it is hereby ORDERED that, by July 13, 2026, Plaintiffs and Defendants shall each file a Statement of Position on this issue. By July 17, 2026, Plaintiffs and Defendants shall file their respective responses. Further, it is hereby ORDERED that the hearing for Oral Argument currently scheduled for July 8, 2026, is CONTINUED generally shall be reset by further order of the Court. The Court will coordinate with the parties to find an available date. Further, it is hereby ORDERED that, by July 13, 2026, Plaintiffs and Defendants shall each file a Statement of Position addressing the extent to which, if any, the relief sought in relation to COUNT II (Violation of the Take Care and Vesting Clauses of Article II of the U.S. Constitution) of the COMPLAINT (ECF No. 1 ) is moot.
