Plaintiff did not file an amended complaint within the twenty-one days permitted by D.E. 46 . As such, Count I (Breach of Contract) is the sole surviving claim in this action. Moreover, fact discovery has closed as of June 30, 2026. D.E. 41 . Accordingly, today's status conference at 3 p.m. is canceled. Within seven days, the parties shall file a joint letter not to exceed 5 single-spaced pages detailing (1) whether the parties are prepared for a settlement conference with the undersigned, (2) the status of remaining discovery, if any, including expert discovery, and (3) any other issues that are ripe for the Court's consideration..
