MEMORANDUM OPINION GRANTING CLASS CERTIFICATION AND ORDER re: (251 in 1:17-cv-01545-LAK) MOTION to Certify Class . filed by Irving Lichtman Revocable Living Trust, New England Carpenters Guaranteed Annuity and Pension Funds, Jupiter Capital Management. For the forgoing reasons, plaintiffs' motion for class certification and other relief (Dkt 251) is granted to the extent that: 1. The BDO Subclass, defined as all purchasers of AmTrust common stock and Series F Preferred Stock between March 3, 2014 and April 10, 2017, inclusive (the "BDO Subclass Period"), who were damaged thereby, is certified under Rules 23(a), (b)(3), and (c)(5) of the Federal Rules of Civil Procedure, provided, however, that BDO USA, P.C. and its partners and/or principals, at all relevant times, as well as members of their immediate families and their legal representatives, heirs, successors or assigns, and any entity in which BDO has or had a control ling interest, are excluded from the BDO Subclass. 2. The North Atlantic Funds and the Living Trust are certified as Class Representatives for the BDO Subclass. 3. Robbins Geller Rudman & Dowd LLP is appointed Class Counsel for the BDO Subclass under Rule 23(g). SO ORDERED. (Signed by Judge Lewis A.
