Order Striking
PAPERLESS ORDER striking the parties' DE 165 Joint Discovery Status Report. For the third time, the parties have failed to conform their Joint Discovery Status Report to the chart format required by this Court's DE 41 Discovery Procedures Order. The Court's previous order DE 164 specifically instructed the parties to use the correct format, provided the exact location of where to find the format (pages 6 and 7 of the Discovery Procedures Order), and warned that failure to do so may result in sanctions. While this may appear to (literally) be an issue of "form over substance," the required format enables the Court to efficiently review the issue(s) in dispute and provide the parties with an expedient resolution. Accordingly, the parties are directed to file a revised Joint Discovery Status Report - that strictly conforms to the format shown in the Court's Discovery Procedures Order - by May 20, 2024, at 5:00 PM. The Court is providing additional time to re-file the Joint Discovery Status Report in the hopes that, in addition to correcting the format, the re-filed Joint Discovery Status Report will contain a more fulsome response from Resolve Equipment, Inc. regarding the disputed items on its privilege log or otherwise reflect updated positions following the additional meet-and-confer that Pennsylvania National Mutual Casualty Insurance Company has requested for Monday, May 20.
