TEXT MINUTE ENTRY for telephonic status conference held before Magistrate Judge Ryan C. Carson on July 14, 2026. Michael Fielding appeared for Plaintiff. No appearance for Defendant Banyan Medical Systems, LLC. Joel Carney appeared for Defendant Buda. Pursuant to the court's order at Filing No. 34 , Mr. Carney agreed to enter his appearance on the docket by close of business today.Discovery began early in the case, prior to Defendant Banyan's bankruptcy filing. Given the case's current posture, the parties discussed whether to refer the case to the bankruptcy court or whether they should seek stay relief in the bankruptcy case as to Defendant Buda. The parties are ordered to meet and confer and file a status report or appropriate motion by Wednesday, July 29, 2026, indicating how they intend to proceed. If the parties believe an additional status call would be beneficial, they are ordered to contact chambers to schedule. The parties also discussed the pending Motion to Substitute (Filing No. 35). Plaintiff indicated prior counsel had no opposition. Mr. Carney requested, and the court granted, an extension to July 17, 2026, to review the motion and inform the court whether there is any opposition.
