ORDER granted in part and denied in part 7 MOTION to Dismiss 1 Complaint . For these reasons, most of Villarreals claims fail to survive BISDs Motion to Dismiss. As a result, it is: ORDERED that Defendant Brownsville Independent School District's Motion to Dismiss Plaintiff's Complaint Pursuant to 12(b)(1) and 12(b)(6) (Doc. 7) is GRANTED IN PART AND DENIED IN PART; and ORDERED that Plaintiff Benita Villarreal's causes of action are DISMISSED WITH PREJUDICE, with the exception of her cause of action alleging that in retaliation for her filing of the 2025 DIA Complaint and 2025 DGBA Grievance, BISD rendered the Findings Report and issued her a Notice of Warning. In addition, to the extent that Plaintiff Benita Villarreal desires to seek leave to amend her Complaint to cure deficiencies identified in this Order and Opinion, it is ORDERED that by no later than November 3, 2026, Plaintiff Benita Villarreal shall file a motion for leave to amend her Complaint, specifying any amendments by submitting a proposed First Amended Complaint.
