The Court acknowledges receipt from counsel for the States requesting an (apparently expedited) ruling on Dkt. 3023 and amending the relief requested by the States. Meta objects to the email's request to amend the requested relief and requests briefing on the issues.
Under Civil Local Rule 7-1(a), "[a]ny written request to the Court for an order must be presented by one of the following" listed types of motions. An email to Court staff is not one of the listed types of methods for presenting requests for an order. See also Section XI of the undersigned's Standing Civil Order ("Unless ordered otherwise by the Court, Parties are not to participate in communications with Court staff. Parties are not to email requests seeking extensions of dates, remote appearances, or status updates on cases.").
The Court ORDERS the Parties to file a Joint Further Discovery Letter Brief addressing the updated issues raised in the Parties' email, to be filed by close of business on August 7, 2026. The Joint Further Discovery Letter Brief SHALL be limited to four pages evenly divided between the Parties.
The Parties are further ORDERED to meet and confer to attempt to reach agreement on the disputes (including disputes which impact authenticity and admissibility of evidence) promptly in advance of the filing of the Joint Further Discovery Letter Brief - to the extent the disputes are resolved or narrowed, the Parties SHALL report on those in the Joint Further Discovery Letter Brief so as to make clear to the Court what disputes remain outstanding for resolution, if any.
The Parties SHALL cooperate reasonably and promptly in preparing the Joint Further Discovery Letter Brief, including timely exchanges of their respective sections to avoid last minute raising of issues which negatively impact the other side from addressing in their section.
