Order on Motion for Extension of Time
ORDER granting in part and denying in part 37 Letter Motion for Extension of Time. Plaintiff has attempted to effectuate service on Mr. Feinberg (i) at his former firm, which correctly declined to accept service on Mr. Feinberg's behalf as his former (not current) employer; and (ii) by requesting the confirmation of Mr. Feinberg's address through Cerberus Capital Management, L.P.'s legal counsel, who do not represent Mr. Feinberg in this matter. Plaintiff now moves the Court for an order authorizing service on Mr. Feinberg by alternative means and extending the time for Plaintiff to complete such service. Plaintiff's application is DENIED in part and GRANTED in part. Plaintiff's two attempts of service one of which was merely a request for information about Mr. Feinberg's whereabouts do not demonstrate that Plaintiff has exhausted all means of effectuating service of Mr. Feinberg. It is apparent from Plaintiff's application that he has not researched all the ways that service can be effectuated through a process server. Moreover, one method that Plaintiff proposes for alternative service is by delivering a summons and complaint to Mr. Feinberg's government office. But this method will almost certainly fail. Accordingly, Plaintiff's request for alternative means of service is DENIED without prejudice to renewal upon a showing that Plaintiff has exhausted of all avenues of service on Mr. Feinberg. However, the Court understands that Plaintiff is undergoing a medical procedure over the next few weeks. The Court wishes Plaintiff well as he undergoes surgery, and GRANTS his application for an extension of time to serve the summons and complaint on Mr. Feinberg. Plaintiff must complete service on Mr. Feinberg on or before January 4, 2027. The Clerk of Court is directed to terminate the pending motion at docket entry 37..
