Text Order
TEXT ORDER: The Court is in receipt of Defendant Cinemark USA, Inc.'s Amended Jurisdictional Statement, D.E. 6 , filed in response to the Court's August 26, 2026 Text Order, D.E. 4 . The Court finds that Cinemark has made a substantial, good faith effort to investigate and resolve the jurisdictional deficiencies identified in the Court's prior Order. Although Cinemark has cured several of those deficiencies, additional information remains necessary to determine the citizenship of Defendants Willowbrook Mall, LLC and Willowbrook FS Anchor Parcel, LLC and, accordingly, whether complete diversity exists. See D.E. 6 at 2-3. Cinemark's request for limited jurisdictional discovery is therefore GRANTED in part. Cinemark shall have 30 days from the date of this Order to conduct jurisdictional discovery narrowly tailored to determining: (1) the members and citizenship of Willowbrook Mall, LLC; and (2) the members and citizenship of Willowbrook FS Anchor Parcel, LLC, including the principal place of business of Westroads-Oaks, Inc., and any other information necessary to trace the citizenship of either LLC through all layers of ownership. The relevant citizenship shall be determined as of the time this action was commenced and removed. Within that same 30-day period, Cinemark shall file a supplemental jurisdictional statement setting forth the results of its investigation and providing sufficient information for the Court to determine whether complete diversity exists. All parties shall reasonably cooperate with this limited jurisdictional discovery. So Ordered by Judge Evelyn Padin on 9/3/2026. (wh)
