Order to Dismiss ~Util - Set Submission Deadline
ORDER TO DISMISS WITHOUT PREJUDICE Plaintiff's Amended Complaint pursuant to 28 U.S.C. § 1915(e)(2)(B)(ii) and DIRECTS the Clerk to close the case. Because Plaintiff is proceeding pro se, the Court GRANTS Plaintiff leave to file a Second Amended Complaint within thirty (30) days of the date of the Order. If the Plaintiff files such amended complaint in the time allowed, the Clerk is DIRECTED to reopen the case and resubmit the matter to the Court for a frivolity review. The Court warns Plaintiff that a failure to correct the deficiencies identified in this Order may result in a dismissal of the claims with prejudice. Signed by Judge Steve C. Jones on 3/03/2026.
