Report and Recommendations
REPORT AND RECOMMENDATIONS re 13 : For the reasons stated in the attached Report and Recommendation, the Court respectfully recommends that Plaintiff's motion for default judgment at ECF No. 13 should be granted in part and denied in part. Specifically: (1) default judgment should be entered against Mana Products, Inc. for breach of contract; (2) De Lage Landen Financial Services, Inc. should be awarded (a) $25,156.57 in damages, including $23,958.64 for unpaid installments between July 2025 and November 2025 and $1,197.93 for late charges on those unpaid installments and (b) post-judgment interest as set forth in 28 U.S.C. § 1961(a); and (3) De Lage Landen Financial Services, Inc.'s request for the accelerated balance due should be denied without prejudice and with leave to submit documents and/or other information to clarify its calculations within 10 days of an order adopting this Report and Recommendation, if any. See attached.
A copy of this Report and Recommendation is being served on Plaintiff via ECF. The Clerk of Court is respectfully directed to mail a copy of this Report and Recommendation and the summary docket sheet to Mana Products, Inc. at the following address forthwith: 32-02 Queens Boulevard, Long Island City, NY 11101 and to email a copy of same to chip.ross@manaproducts.com and olivia.dupuy@manaproducts.com, the email addresses Mana Products, Inc. used for pre-suit communications.
Within 14 days of service, any party may serve and file specific written objections to this Report and Recommendation. 28 U.S.C. § 636(b)(1)(C); Fed. R. Civ. P. 72(b). Any requests for an extension of time to file objections shall be directed to Judge Donnelly. If a party fails to object timely to this Report and Recommendation, it waives any right to further judicial review of this decision. See Nambiar v. Cent.
