TEXT ORDER-- The Court has reviewed the parties letters at ECF Nos. [29[, 30 and 31 concerning a discovery dispute as to whether Plaintiff can be forced to reenact the mechanism of injury that allegedly occurred on October 15, 2022 while he was working on the tug EmilyAnn. Defense counsel shall contact the current owner of the EmilyAnn to ascertain (i) when the tug will complete its current job and return to the tri-state area; and (ii) whether the current owner will consent (subject to a court order if necessary) to allowing counsel and parties to board the tug for the limited purpose of inspection and the taking of a brief video-taped deposition wherein Plaintiff can reenact what occurred on the date of his injury in the engine room of the boat, and shall file a letter with the Court regarding same by August 14, 2026. The Court will then determine next steps. In the interim, the deadline for fact discovery is extended until September 30, 2026; the settlement conference shall proceed as scheduled on August 11, 2026; and the deadlines for expert discovery shall be held in abeyance and will be addressed by the Court at a later conference.
