ORDER: On June 2, 2026, the Court issued its Order Selecting Smith and DiCello Firms' Opt-Out Cases For Limited Discovery, explaining that "[t]he Court would like to gain a better understanding of the possible reasons" why those firms had "exceedingly high opt-out rates" from the global settlement proposal. (Doc. 5833). The Court ordered limited discovery, including depositions, to "assist the Court in gathering more information on these Plaintiffs and their claims." The Court also ordered the submission of case summaries on a rolling basis. The Court has reviewed the materials it has received to date and seeks further information regarding the DiCello Firm's settlement opt-outs. The Court therefore ORDERS attorney Mark DiCello to appear before the Court on Thursday, August 27, 2026, at 1:00 p.m. via video conference.
