Motor Vehicle Prod. Liability | Georgia Northern
Order on Motion to Dismiss Order on Motion to Dismiss for Failure to State a Claim Order on Motion for Oral Argument Order on Motion for Leave to File Order on Motion for Discovery
OPINION AND ORDER. For the reasons set forth above (SEE ORDER), the Court GRANTS IN PART AND DENIES IN PART the Motion to Dismiss by the Airbag Suppliers, [Doc. 178 ], ARC, [Doc. 179 ], the U.S. Automakers (collectively), [Doc. 181 ], Hyundai and Kia, [Doc. 180 ], Volkswagen, [Doc. 182 ], BMW, [Doc. 183 ], Ford, [Doc. 185 ], GM, [Doc. 186 ], PCNA, [Doc. 187 ], and Fiat Chrysler, [Doc. 188 ]. Specifically, the Court GRANTS the above-identified motions for Plaintiffs' failure to state a claim to the extent that it DISMISSES WITH PREJUDICE those claims asserted in the SAC, [Docs. 157 , 157-1], that are identified in the discussion above (and duplicated for ease of reference in the chart appended to this order), STRIKES Plaintiffs' request for restitution as a remedy under their statutory consumer protection claims, DISMISSES AS MOOT the claims against GM by Plaintiffs Allan, Barber, A.W. Brown, Diaz, Eiland, Felice, Jophlin, Lovett, Senkpeil, Shephard, Stowe, Struble, Warren, and Welch, and DENIES the motions in all other respects, unless indicated otherwise below. Further, the Court GRANTS Audi's Motion to Dismiss for lack of standing, [Doc. 184 ], and DISMISSES WITHOUT PREJUDICE Plaintiffs' claims against it. The Court also GRANTS Hyundai Korea and Kia Korea's motion to dismiss, [Doc. 272 ], for failure to state a claim and DISMISSES WITH PREJUDICE all claims by Plaintiffs against these two Defendants. The Court further GRANTS ARC's motion to dismiss, [Doc. 179 ], for lack of personal jurisdiction and DISMISSES WITHOUT PREJUDICE the cases identified in the discussion above (and duplicated for ease of reference in the chart appended to this order). To the extent that ARC is the sole Defendant in a given case, the case stands dismissed in its entirety, and to the extent that ARC is a co-Defendant, ARC stands dismissed from the case for lack of personal jurisdiction but the case proceeds against any other Defendant. Signed by Judge Thomas W. Thrash, Jr. on 10/2/2026. (Attachments: # 1 Disposition Chart) (tcc)
