Order Striking Document from Record
ORDER: Accordingly, as these recent submissions are immaterial to the instant issue, and as the Gottliebs were made aware of the potential consequences of failing to comply with the Court's orders, docket entries 529, 533, and 534 are stricken pursuant to Federal Rule of Civil Procedure 16(f). See Fed. R. Civ. P. 16(f)(1)(C) (permitting courts to strike submissions that do not comply with an order). Mr. Gottlieb is further reminded of the limitations of his modified filing bar and that future filings unrelated to the instant issue may also be stricken. Additionally, it appears that the Gottliebs did not brief the issue of Mrs. Gottlieb's dollar-value contributions to the marital home. Nor did they retain counsel to do so on their behalf. Mr. Eisemann, in seeking to protect his interest in the litigation as former counsel to the Gottliebs, moved for an extension of time, which the Court granted, so that he may file a submission on behalf of Mrs. Gottlieb. (Dkt. nos. 531-32.) As such, Mr. Eisemann's submission is due no later than June 10, 2024, after which the SEC shall file its opposition no later than June 24, 2024. (Dkt. no. 532.) Any replies thereto are due no later than July 1, 2024. For the foregoing reasons, the Clerk of the Court is directed to strike docket entries 529, 533, and 534. SO ORDERED. (Signed by Judge Loretta A. Preska on 5/17/2024) (vfr) Modified on 5/17/2024 (vfr).
