Howard Matz: re: MOTION for Summary Judgment 116 : The Court has not been able to turn to Defendants Motion for Summary Judgment, Dkt. 116, which was taken under submission on November 28, 2011. The Court assumes that this is the reason the parties have not filed their briefs for the upcoming Markman hearing on March 9, 2012. Accordingly, the parties are ORDERED to file separately, by no later than February 29, 2012, a single-page statement explaining whether they believe the Court can and should rule on the pending summary judgment motion regardless of thedetermination of claim construction issues and before any Markman hearing. Meanwhile, the March 9, 2012, Markman hearing is vacated and will be rescheduled if necessary. (se)
