ORDER that the Joint Motion for a Briefing Schedule is GRANTED; and is it further ORDERED the following schedule shall apply in this case: Defendants shall file the certified administrative record on or before August 10, 2026; Plaintiff shall file its motion for summary judgment and memorandum in support thereof on or before September 16, 2026; Defendants shall file their cross-motion for summary judgment and combined memorandum in support thereof and in opposition to Plaintiff's motion for summary judgment on or before October 21, 2026; Plaintiff shall file its combined opposition to Defendants cross-motion for summary judgment and reply memorandum in further support of its motion on or before November 11, 2026; and Defendants shall file their reply memorandum in further support of their cross-motion for summary judgment on or before December 2, 2026; and The parties will notice the matter for a hearing on Wednesday, December 9, 2026, at 10:00 am; and it is further ORDERED that the Courts Initial Scheduling Order issued on July 20, 2026 (Dkt. 13) is VACATED, and the initial pretrial conference set for August 19, 2026 at 11:00 am is CANCELLED.
