Notice of Appearance
NOTICE of Appearance by Luke P. Sbarra on behalf of Spinoso Real Estate Group DLS, LLC (Sbarra, Luke)
Order on Motion for Entry of Default Order on Motion to Strike
TEXT-ONLY ORDER: Because the Court favors resolving disputes on their merits, the Clerk is directed to accept Defendant Spinoso Real Estate Group's belatedly filed Answer (Doc. No. 60) as timely filed. In light of that Answer, Plaintiff's Request for Entry of Default as to Defendant Spinoso Real Estate Group (Doc. No. 50) and Motion to Strike Answer to the Amended Complaint (Doc. No. 63) are denied as moot. Further, under the Local Rules, any Motion to Dismiss must be filed separately from the Answer. To be considered as filed at the time of the Answer (and thus timely filed), Defendant Spinoso Real Estate Group must file its Motion to Dismiss on or before July 2, 2026. So Ordered. Entered by District Judge Kenneth D. Bell on 6/18/2026. (mek)
