MINUTE entry before the Honorable Lindsay C. Jenkins: The Daubert motions 573 579 589 591 593 635 are granted in part and denied in part. Plaintiffs' motion for sanctions 587 and their motion to strike 602 are both denied. Plaintiffs' motion for class certification under FRCP 23 567 is granted. With respect to Count I, the class is certified as follows: Local exchange carriers that had inter-MTA calls placed to their wireline customers that originated from a T-Mobile USA, Inc. wireless customer during the period of January 1, 2014 through October 24, 2017, as identified on the lists produced by Plaintiffs at bates numbers Plaintiffs_0000200625 (Rural OCN's tab only) and Plaintiffs_0000200626 (collectively, the "Rural LECs") or the list produced by Plaintiffs at Exhibit 4 to the Expert Report of Dave Blessing ("High Cost LECs"). With respect to Counts II and III, the class is certified as follows: Local exchange carriers that had inter-MTA calls placed to their wireline customers that originated from a T-Mobile USA, Inc. wireless customer during the period of January 1, 2014 through October 24, 2017, as identified on the lists produced by Plaintiffs at bates numbers Plaintiffs_0000200625 (Rural OCN's tab only) and Plaintiffs_0000200626 (collectively, the "Rural LECs"). The court's written Order to follow shortly. Lastly, class certification is often a significant inflection point in a case, so the court urges the parties to consider engaging seriously with settlement given the age of the case, and the time, resources, and expenses that will be needed to resolve this litigation to its conclusion. The court is prepared to refer the case to the magistrate judge for a settlement conference or provide time for the parties to re-engage in mediation.
