Compel Arbitration Remand Case to State Court
MINUTES (IN CHAMBERS) by Judge Mark C. Scarsi: ORDER RE: MOTION TO REMAND AND MOTION TO COMPEL ARBITRATION 16 - 17 . Plaintiff Anthony Pineda initiated this putative wage and hour class action against Defendants LTIMindtree Limited and Larsen & Toubro Infotech Limited in the Los Angeles County Superior Court. Defendants removed the case to this Court. Plaintiff moves to remand one of his claims to the state court. Separately, Defendants move to compel arbitration of Plaintiff's claims. The motions are fully briefed. The Court deems both motions appropriate for decision without oral argument and vacates the motion hearings set for April 13, 2026. The Court denies the motion to remand and grants the motion to compel arbitration in substantial part. The Court orders the parties to submit this action to arbitration within 30 days pursuant to the terms of the arbitration agreement. The case is stayed pending resolution of the arbitration. The Court directs the Clerk to remove the case from the Courts active caseload until further application by the parties or order of this Court. The parties shall file a joint status report within 120 days, and a further report every 120 days thereafter. Each report must state on the cover page the date the next report is due.
