MEMORANDUM ORDER & OPINION re: 21 MOTION to Dismiss Plaintiff's Complaint filed by Legg Mason, Inc., Legg Mason & Co., LLC, Franklin Resources, Inc. For the reasons stated above, Defendants' motion to dismiss (Dkt. No. 21) is granted in part and denied in part. The motion is granted as to Counts I, III, IV, V, and VI. The motion is also granted as to Count II to the extent that Plaintiff asserts a claim for benefits under the Severance Plan. The motion to dismiss is otherwise denied. In accordance with Rule 16 of the Federal Rules of Civil Procedure, this court will conduct a case management conference in this case at 11:00 a.m. on October 22, 2026, in Courtroom 705 of the Thurgood Marshall United States Cour thouse, 40 Foley Square, New York, New York. By October 19, 2026, the parties will file a joint status letter and proposed Case Management Plan and Scheduling Order, in accordance with this Court's Individual Rules of Practice in Civil Cases. A model Civil Case Management Plan and Scheduling Order is available on the Court's website (https://www.nysd.uscourts.gov/hon-paul-g-gardephe).
