Initial Conference Hearing
Electronic Minute Order for the Initial Conference held on October 2, 2026, before Magistrate Judge James M. Wicks.

THE FOLLOWING RULINGS WERE MADE:
Following discussion with counsel during the Initial Conference, the Court adopted a Scheduling Order which is attached at ECF No. 15 .
The Court made a disclosure on the record for counsel to consider. Any objection or motion must be filed on or before October 7, 2026.
As mentioned during the Initial Conference, counsel for the parties are reminded to review Docket Entry No. 3 , concerning the assignment of a Magistrate Judge to oversee this case and Administrative Order No. 2025-14. By October 9, 2026, the parties MUST review and file EITHER the Notice of Option to Consent to Magistrate Judge Jurisdiction form consenting to the jurisdiction of the undersigned OR the Direct Assignment Program Acknowledgement form that confirms that they have conferred with each other and their respective client(s) regarding the option to consent to the undersigned. If the parties do not consent to the undersigned by the date set forth above, and have filed the Direct Assignment Program Acknowledgement form, the Clerk of Court will be directed to randomly assign a District Judge to this case. In that event, this Court will remain on the case and preside over all non-dispositive pretrial matters unless the assigned District Judge orders otherwise. The parties are advised that pursuant to Fed. R. Civ. P. 73(b)(2), the parties are free to withhold consent without any adverse substantive consequences.
The parties expressed interest in attempting to reach an amicable resolution. Accordingly, after November 20, 2026, the case shall be referred to the EDNY Mediation Panel. For assistance with any questions about the mediation process or the selection of a mediator, counsel are invited to contact the EDNY ADR Administrator Krysta Hartley at (718) 613-2578. The selection of a Mediator shall be completed by December 11, 2026. Mediation shall be completed by January 11, 2027. The parties are directed to file a joint Status Report on or before January 18, 2027, advising the Court as to whether the matter has settled, or, if not settled, advising the Court on what discovery is outstanding.
