MINUTE ORDER for proceedings held before Magistrate Judge Kellie M. Barr: The Parties, by counsel, appeared for a Telephonic Status Conference on October 1, 2026, with Magistrate Judge Kellie M. Barr. Counsel reported to the Court on discovery progress and overall case status. Counsel and the Court also discussed whether the Parties intend to engage in a settlement conference with the Court or a private mediation ahead of the dispositive motions deadline. Counsel are ORDERED to meet and confer and file a joint statement regarding that meet and confer no later than October 15, 2026. If they report that they prefer a settlement conference with the Court, the joint statement shall state the preferred location (in-person Indianapolis or Zoom) and preferred month. If they prefer a private mediation, the joint statement shall state the selected mediator. Counsel for both Plaintiff and Defendant reported that they intend to file a dispositive motion in this case. Counsel must meet and confer and no later than December 1, 2026, counsel must file a joint motion for cross-motion for summary judgment briefing schedule with a proposed order that sets forth the briefing schedule that they propose. Counsel shall review the District Judge's Procedures and Trial Practices to ensure their proposed cross-motion briefing schedule complies. [See dkt. 34.] Signed by Magistrate Judge Kellie M. Barr.
