Order on Motion for Protective Order
ORDER: GRANTING International's 423 Motion for Protective Order. Rule 30(b)(6) requires that a party's deposition notice "describe with reasonable particularity the matters for examination." Fed. R. Civ. P. 30(b)(6). Topic No. 43 does not do so: it is overly broad and vague. It is also partly duplicative of written discovery that Hirschbach conducted pursuant to the Court's order on September 30, 2025 (Doc. 356 ). However, today's order should not be construed as a blanket prohibition of any discovery relating to the December 20, 2020 settlement agreement. Parties may conduct targeted, written discovery on this topic.As for the Court's Order on September 30, 2025, stating that Hirschbach "may seek permission from the Court to conduct targeted discovery into this issue [of the settlement agreement], as necessary," the Court now clarifies that Hirschbach no longer needs to do so. (Doc. 356 , p. 5). Those directions were given in the context of an upcoming discovery deadline and the Court's concern that unrestricted discovery might lead to delays. However, given that the parties recently requested, and were granted, a generous extension on the discovery deadline, this concern no longer applies. (Doc. 427 ). Signed by Judge Nancy J.
