ORDER: [For the reasons set forth], it is hereby ORDERED that Plaintiff is granted only the following discovery: A. Within 14 days of the date of this Order, Plaintiff may serve targeted interrogatories, pursuant to Rule 33 of the Federal Rules of C ivil Procedure, and/or targeted document requests, pursuant to Rule 34 of the Federal Rules of Civil Procedure, limited to (1) the "feedback" report that allegedly is missing from the administrative record; (2) the review "checklists&q uot;; and (3) information regarding documents that were deleted from the administrative record. B. Within 14 days of the date of this Order, Defendants shall produce to Plaintiff the following documents: (1) documents that set forth the bases upon wh ich Robert Lane, Travis Thomas, Dr. Yeung and/0r Dr. Mkparu may have received incentive compensation in 2025 and 2026, and (2) documents sufficient to show the financial incentives provided to Robert Lane, Travis Thomas, Dr. Yeung and Dr. Mkparu for 2025 and 2026. C. Within 14 days of the date of this Order, Defendants shall produce to Plaintiff performance evaluations for Robert Lane, Travis Thomas, Dr. Yeung and Dr. Mkparu for 2025 and 2026. IT IS FURTHER ORDERED that this case shall proceed w ith the following schedule: 1. Any motion to amend or to join additional parties shall be filed no later than September 3, 2026. 2. Fact discovery shall be completed no later than November 30, 2026. 3. If Plaintiff seeks any expert discovery, he shall make a motion for leave to take such discovery no later than December 14, 2026. Status Conference ~Util - Set Deadlines
MINUTE ENTRY & ORDER for proceedings held before Magistrate Judge Marcia M. Henry: A telephone status conference was held on 08/20/2026. Ilya Schwartzburg appeared on behalf of the Plaintiffs. Erina R. Ponzini appeared on behalf of Defendants Dorris N. Green and William E. Ramos. Defendant Anthony Rodriguez appeared pro se.
The Court addressed Plaintiff's motion to dismiss Defendant Rodriguez's counterclaim for breach of contract (ECF No. 24 ). Defendant Rodriguez stated intent to withdraw the breach of contract counterclaim. By 08/27/2026, Defendant Rodriguez must file a letter or a notice of voluntary dismissal stating that he is withdrawing his counterclaim for breach of contract. See Fed. R. Civ. P. 41.
With respect to discovery, the Court admonished the parties that they must cooperate to move discovery forward in this case and reminded Defendant Rodriguez that he must comply with the Federal Rules of Civil Procedure to obtain discovery in this case. By 09/21/2026, Plaintiffs shall produce a copy of the complete insurance claim file on all parties. Plaintiffs must serve a copy of the file on Defendant Rodriguez via mail and email.
The parties shall appear for a status conference on 10/16/2026 at 2:00PM, for which a separate Scheduling Order shall issue. The parties should be prepared to discuss the status of depositions, the close of discovery deadlines, and a possible resolution of this matter.
