    Status Report Order

    ORDER: The Court has not yet placed this case on a list of trial-ready cases where a pro se party is seeking pro bono counsel. Appointment of counsel in civil cases is reserved for exceptional circumstances. See, e.g., Mallard v. U.S. Dist. Ct. for S. Dist. of Iowa, 490 U.S. 296, 310 (1989). One of the prerequisites to appointing counsel is that a pro se plaintiff is unable to find counsel on their own. See, e.g., Herbert v. Sanfeliz, 22-CV-4299, 2025 WL 2939265 at *2 (S.D.N.Y. Oct. 16, 2025) ("Plaintiff must show that he has made a 'reasonably diligent effort under the circumstances' before appointment of counsel will be considered.") (quoting Jenkins v. Chem. Bank, 721 F.2d 876, 880 (2d Cir. 1983)). Here, Plaintiff recently reported to the Chambers via email that she has only just begun to search for an attorney. Before taking further steps to appoint counsel, the Court must be satisfied that Plaintiff has made a sufficient effort to find counsel on her own. Plaintiff shall file a status letter by 8/25/2026 reporting what efforts she has taken to try to find counsel. So Ordered by Magistrate Judge Seth D. Eichenholtz on 7/27/2026. (DC)

    Initial Conference Hearing ~Util - Set Deadlines/Hearings

    Minute Entry and Order: An Initial Conference was held via video on 7/23/2026 before Magistrate Judge Taryn A. Merkl. Appearances by Jeremiah Joseph Iadevaia and Shira Kotz for Plaintiff; Jeffrey M. Schlossberg and Cliff LaFemina for Defendants. Ms. Kotz is advised that if she intends to appear on Plaintiff's behalf going forward, she should file a notice of appearance. See Loc. Civ. R. 1.4(a).

    The parties confirmed that they have held their Rule 26(f) conference. The Court also reminded the parties of their obligations to preserve and, if appropriate, produce electronically stored information during discovery. The parties' proposed confidentiality order shall be filed on ECF by 8/18/2026. As stated on the record, the parties' discovery plan is adopted, in part, as follows. Rule 26(a) initial disclosures and any HIPAA-compliant records authorizations shall be exchanged by 8/6/2026. First requests for documents and interrogatories shall be exchanged by 9/4/2026. Phase I discovery shall be completed by 10/16/2026. The deadline for joining additional parties and amending the pleadings as of right is 11/13/2026. Fact discovery shall be completed on or before 2/17/2027. The parties are directed to file a joint status report certifying the close of fact discovery by 2/24/2027. Plaintiff shall disclose her experts by 2/17/2027. Defendants' experts shall be disclosed by 3/26/2027. Expert depositions shall be completed by 4/19/2027. All expert discovery shall be completed by 4/30/2027, and certification of the completion of all discovery shall be filed on ECF by 5/7/2027. The last date to take the first step in dispositive motion practice is 6/4/2027, and must be done in accordance with the Individual Rules of the assigned District Judge.

    The parties are directed to file a joint status report by 10/22/2026, including an update as to their progress on discovery, any settlement discussions, whether the case should be referred for mediation or a settlement conference, either before the Court or another magistrate judge, as well as whether the below Pre-Settlement Status Conference is still needed. A telephonic Pre-Settlement Status Conference will be held on 10/29/2026 at 10:00 a.m. before Magistrate Judge Taryn A. Merkl. The Court notes, that because it is a pre-settlement status conference, the parties are not required to attend. Counsel are directed to call the dial-in number (571) 353-2301.
