The Court is in receipt of Plaintiff's Opposition to Intervenor-Defendant's Motion to Dismiss and Reply (Doc. No. 64). The Court has not yet granted Plaintiff leave to file this response, which is the subject of Plaintiff's pending Motion for Leave to File Opposition to Intervenor-Defendant's Motion to Dismiss Out of Time (the "Motion for Leave") (Doc. No. 61). For this reason, the Court UNFILES Plaintiff's Opposition to Intervenor-Defendant's Motion to Dismiss and Reply (Doc. No. 64).
In its previous order addressing Plaintiff's Motion for Leave, the Court expedited "Plaintiff's time to file a reply" to October 1, 2026. Doc. No. 63. Instead of filing a reply to its Motion for Leave, Plaintiff filed its Opposition to Intervenor-Defendant's Motion to Dismiss. The undersigned believes the previous order was clear. However, the Court prefers to allow complete briefing for all parties to be heard and also to prevent any further motion practice on this issue. Accordingly, Plaintiff has a FINAL opportunity to file a reply to its Motion for Leave (Doc. No. 61) by TODAY, October 2, 2026. This deadline will not be extended again.
There shall be NO FURTHER FILINGS related to Plaintiff's Motion for Leave UNLESS ORDERED BY THE COURT.
