TEXT ORDER: Having received and reviewed the parties' letters concerning Plaintiff's request that the Court set a response deadline for all Defendants who do not intend to move to dismiss the First Amended Complaint, see ECF Nos. 97, 98, 99, 100, 101; and the Court noting that the individual defendants, Mr. Cairo and Mr. Schneider, seek leave to file a Motion to Dismiss, see ECF No. 97; and the Court further noting that service of the First Amended Complaint on the New Defendants is disputed, while service on the Original Defendants, including Mr. Cairo and Mr. Schneider, is not disputed; and the Court having considered the parties' arguments; and for good cause shown, it is ORDERED that Plaintiff's request that the Court set a deadline for the non-moving Defendants to respond to the First Amended Complaint is GRANTED IN PART and DENIED IN PART. Because service of the First Amended Complaint on the New Defendants is disputed, the Court cannot, on the present record, set a deadline for those Defendants to respond. Therefore, it is hereby ORDERED that all Original Defendants (Strategic Funding Alternatives, LLC; SFA 50 Millstone Road, LLC; SFA LLC a/k/a SFA LLC II; Jeffrey Schneider; and John Cairo) shall answer, move, or otherwise respond to the First Amended Complaint no later than August 31, 2026. It is further ORDERED that Plaintiff's request to set a deadline for the New Defendants to answer, move, or otherwise respond to the First Amended Complaint is DENIED because service of the First Amended Complaint on those Defendants is disputed. It is further ORDERED that the Court will conduct a telephone status conference on September 28, 2026, at 3:00 p.m. Counsel shall dial 1-856-210-8988, access code 273386889# to connect to the call. At least three (3) days prior to the scheduled conference, the parties shall send the Court a letter identifying all discovery disputes, if any. No issue will be addressed unless the parties have first conferred pursuant to Local Civil Rule 37.1(a) by speaking in person, by telephone, or by video conference.
