Order(Other)
ORDER: The Court is in receipt of Defendants' letter response, Dkt. 11, to the Court's 6/10/2026 Order to Show Cause, see also Plaintiff's Formal Demand, Dkt. 12. In light of the allegations in the case, as well as the email sent by Plaintiff's counsel to Defendants' counsel, in which counsel states [Plaintiff's] demand is for the full BI limits which have been disclosed as 2M, Dkt. 11, Exhibit 1 and Dkt. 12, the Court finds that Defendants have proffered sufficient information to establish that the amount in controversy requirement for diversity jurisdiction is satisfied. The Court therefore declines to take any further action on the order to show cause at this time. See Lupo v. Human Affairs Int'l, Inc., 28 F.3d 269, 273 (2d Cir. 1994) ("While a [party] need not 'prove the amount in controversy to an absolute certainty,' the [party] 'has the burden of proving that it appears to be a reasonable probability that the claim is in excess of the statutory jurisdictional amount.'). Ordered by Judge Orelia E. Merchant on 9/11/2026. (MLB)
