MEMO ENDORSEMENT on re: (12324 in 1:03-md-01570-GBD-SN) ENDORSEMENT: The Court accepts most of the Plaintiff's amendments because they were filed consistent with the procedures established in ECF No. 5234. Three amendments were not properly included in this Notice of Amendment, however, and the Court therefore DENIES them. The attached Exhibit A lists three plaintiffs as "Court Appointed Representative[s]" of the corresponding 9/11 decedents. ECF No. 12324 at 6-7 (Renee Hill, Donovan Jackson, and Peter Lizzio). New plaintiffs may use a Notice of Amendment to add their claims only if they are "asserting claims for solatium damages with respect to a deceased family member whose estate previously filed claims against Saudi Arabia." ECF No. 5234 at 5. This amendment procedure does not apply to designating personal representatives for the estates of 9/11 decedents. Instead, the three plaintiffs (Hill, Jackson, and Lizzio) should file a motion to substitute themselves as plaintiffs. See, e.g., ECF No. 12269. The Court thus denies the amendments for Hill, Jackson, and Lizzio. SO ORDERED.
