Stipulation and Order of Voluntary Dismissal
STIPULATION OF DISMISSAL WITHOUT PREJUDICE: IT IS HEREBY STIPULATED AND AGREED, by and between the undersigned counsel for all parties, that: 1. The Subpoena is hereby withdrawn, and Red Hat shall not take any further action to enforce the Subpoena or to serve TRGP with a new subpoena until after the expiration of the Stay of the Red Hat Action; 2. TRGP will preserve all documents responsive to the Subpoena during the pendency of the Stay and for forty-five (45) days after the Stay is lifted; 3. This Miscellaneous Action is hereby voluntarily dismissed without prejudice, pursuant to Federal Rule of Civil Procedure 41(a)(1)(A)(ii), and all pending motions in this Miscellaneous Action are hereby withdrawn; and 4. Red Hat and TRGP reserve all rights and expressly acknowledge that this Stipulation is without prejudice to either: (i) Red Hat's right to re-serve and pursue enforcement of the Subpoena after the Stay is lifted; or (ii) TRGP's right to object to or otherwise challenge enforcement of the Subpoena, including by re-filing the Motions and seeking its attorneys' fees and costs. The parties have stipulated to the dismissal of this action without prejudice under F.R.C.P. 41(a)(1)(A)(ii). The Clerk of Court is directed to close this case. SO ORDERED.
