Order Staying Case ~Util - Terminate Motions
PAPERLESS ORDER. THIS CAUSE came before the Court upon Defendants' Unopposed Motion to Compel Arbitration and Stay Proceedings Pending Arbitration. 13 . Therein, Defendants request the Court stay this case pending the completion of arbitration and compel arbitration under the Federal Arbitration Act and in accordance with the arbitration agreement entered into between the Parties. See generally id. Further, Defendants request that the Court compel arbitration of Plaintiff's claims against Defendant Restaurant Brands International US Services LLC, pursuant to the doctrine of equitable estoppel, which "allows a nonsignatory to an arbitration agreement to compel arbitration if a signatory's claim against it 'is inextricably intertwined with [their] claims against the contract signatory,'" Id. at 5; Mcadoo v. New Line Transp., LLC, No. 8:16-cv-1917, 2017 WL 942114, at *5 (M.D. Fla. Mar. 9. 2017) (quoting Escobal v. Celebration Cruise Operator, Inc., 482 F. App'x 475, 476 n.3 (11th Cir. 2012). Defendants also indicate that Plaintiff agrees to the relief requested. 13 at 1, 3, 6. Given the Parties' assent, the arbitration agreement, and the arbitrability of Plaintiff's claims, the Court finds it is appropriate to compel the Parties to submit this matter to arbitration and to stay this matter pending the outcome of arbitration. See generally 13 ; 9 U.S.C. §§ 3, 4. Accordingly, UPON CONSIDERATION of the Motion, the pertinent portions of the record, and being otherwise fully advised in the premises, it is hereby ORDERED AND ADJUDGED that the Motion 13 is GRANTED. The Parties are ORDERED to submit all relevant claims asserted in the Complaint to arbitration. This case is hereby STAYED pending the outcome of the arbitration proceedings. The Parties are directed to notify the Court of the outcome of the arbitration within thirty (30) days of its completion. The Clerk of Court is INSTRUCTED to ADMINISTRATIVELY CLOSE this case.
