MINUTE ORDER issued by Courtroom Deputy for Chief District Judge Troy L. Nunley on 10/14/2026: The Court has reviewed Manufacturer Defendants' Statement Regarding the Court's Initial Pretrial Scheduling Order (ECF No. 38 ). The request that the Court refrain from entering a scheduling order or setting deadlines is DENIED WITHOUT PREJUDICE. The Court understands Defendants to seek a stay of the deadlines set forth in the Court's Initial Pretrial Scheduling Order (ECF No. 14 ) pending resolution of the MSA Dispute or the Court's ruling on Plaintiff's Motion to Remand (ECF No. 23 ). The deadlines established by the Initial Pretrial Scheduling Order, however, are triggered by "the date upon which the last answer may be filed with the Court pursuant to the Federal Rules of Civil Procedure, or from the date of removal, whichever is later," and no answer is due until 21 days following entry of any order denying Plaintiff's Motion to Remand. (ECF Nos. 10 , 14 .) Because that triggering date has not yet occurred, there are no deadlines to vacate at this time. Should modification of the pretrial scheduling order become necessary, the parties may submit a renewed stipulation and proposed order at that time. (TEXT ONLY ENTRY) (Deputy Clerk MDK)
