ORDER-Defendants Kuzzins, Ritz Carlton, and CPLG's Motions to Dismiss [ECFs 35 , 42 , 69 ] are GRANTED in part and DENIED in part. Counts II and III are DISMISSED as to all Defendants for failure to state a claim; only Count I shall proceed. Further, M.W.'s Motion to Proceed Under Pseudonym [ECF 54 ] is GRANTED. Kuzzins, Ritz Carlton, and CPLG shall file their Answer to the surviving portions of the FAC within 14 days of this Order. The parties' Joint Preliminary Report and Discovery Plan must be filed within 30 days of this Order. The Clerk is DIRECTED to submit this Order to undersigned after 30 days. Signed by Judge Steven D.
