(TEXT-ONLY) NOTICE OF HEARING on ORDER to SHOW CAUSE via ZOOM: Under Federal Rule of Civil Procedure 4(m), "[i]f a defendant is not served within 90 days after the complaint is filed, the court -- on motion or on its own after notice to the plaintiff -- must dismiss the action without prejudice against that defendant or order that service be made within a specific time." Fed. R. Civ. P. 4(m). But, if a plaintiff shows good cause for the failure of service, then then court must permit an extension of time for the plaintiff to serve the defendants. Id. It is ultimately the plaintiff's burden to effectuate service. See Fed. R. Civ. P. 4(c). With that said, it is still within this Court's broad discretion to consider whether an extension of time to serve is warranted. See Salazar v. City of Albuquerque, 278 F.R.D. 623, 626 (D.N.M. 2011) (citing Espinoza v. United States, 52 F.3d 838, 840-41 (10th Cir. 1995)). Here, the proper next step is to set a hearing to provide Plaintiff a chance to show cause for failing to effectuate service upon Defendants. See Self v. Autoliv, ASP, 61 Fed.Appx 583, 584 (10th Cir. 2003). This matter will be held via ZOOM; the Court will email the link.
