EO: ORDER DIRECTING PLAINTIFFS TO FILE A LETTER BRIEF AND ALLOWING DEFENDANT TO FILE AN OPTIONAL RESPONSE LETTER BRIEF
  On August 8, 2023, this Court issued a temporary restraining order. See Order Granting in Part and Denying in Part Plaintiffs' Motion for Temporary Restraining Order and Preliminary Injunction, filed 8/8/23 (dkt. no. 66), at 90-91, available at 686 F. Supp. 3d 1034. The temporary restraining order was subsequently converted to a preliminary injunction. See Joint Stipulation to Convert Temporary Restraining Order to Preliminary Injunction and to Stay Further Proceedings in the District Court Pending Appeal, filed 9/6/23 (dkt. no. 80). The portion of the injunction enjoining Hawai`i Revised Statutes Sections 134-9.1(a)(4) and 134-9.1(a)(9), 686 F. Supp. 3d at 1076-77, was reversed pursuant to the Opinion issued by the Ninth Circuit Court of Appeals on August 10, 2026. See dkt. no. 102 at 10, available at 2026 WL 2291925.
  Although the Ninth Circuit has not yet issued its mandate, this Court ORDERS Plaintiffs Jason Wolford, Alison Wolford, Atom Kasprzycki, and Hawaii Firearms Coalition ("Plaintiffs") to file a letter brief, not to exceed five pages, addressing whether any further briefing is necessary to address the remaining issues in this action in light of the Ninth Circuit's Opinion. Plaintiffs' letter brief must be filed by September 1, 2026. Defendant Anne E. Lopez, in her official capacity as the Attorney General of the State of Hawai`i ("the State"), may file an optional response letter brief, not to exceed five pages. If the State elects to file an optional response letter brief, it must be filed by September 8, 2026. After reviewing the letter brief(s), this Court will determine whether oral argument is necessary.
