REPORT AND RECOMMENDATIONS re 36 MOTION for Summary Judgment and Memorandum in Support filed by Smith's Layton Distribution. For the foregoing reasons, the RECOMMENDS that the District Court grant Defendant Smith's 36 Motion for Summary Judgment and dismiss all claims in Plaintiff's complaint. Plaintiff fails to carry her burden of showing a genuine issue for trial. As a result, summary judgment is appropriate and should be granted in Smith's favor on all claims. Within fourteen (14) days of being served with a copy, any party may serve and file written objections. Failure to object may constitute a waiver of objections upon subsequent review.
