Initial Conference Hearing
Minute Entry and Order: An Initial Conference was held via telephone on 10/14/2026 before Magistrate Judge Taryn A. Merkl. Appearances by Pro Se Plaintiff Shang Wen Lin and Eric Savage and Jena Silverman for Defendant. Discussion held regarding case status and discovery progress. The parties expressed an interest in mediation and Plaintiff represented a willingness to narrow the scope of her initial requests for production in an effort to expedite preparation for mediation. Plaintiff also represented that she has retained counsel for the limited purpose of representing her with respect to any mediation proceedings. By 10/28/2026, the parties are directed to file a joint letter, indicating whether the parties seek a referral to the EDNY Mediation Program. In the event the parties request a referral, the letter shall include proposed deadlines to select the mediator and to complete mediation. In the event the parties intend to pursue private mediation, the letter due by 10/28/2026 should provide an overview of the anticipated timing for mediation.
As to discovery, the Court reminded the parties of their obligations to preserve and, if appropriate, produce electronically stored information during discovery. In addition, as stated on the record, the parties' discovery plan is adopted, in part, as follows. The parties' proposed confidentiality order shall be filed on ECF by 10/28/2026. Rule 26(a) initial disclosures and any HIPAA-compliant records authorizations shall be exchanged by 10/28/2026. As discussed on the record, Plaintiff is respectfully encouraged to review Rule 26(a) of the Federal Rules of Civil Procedure to confirm what should be included in her initial disclosures. Phase I discovery shall be completed by 11/30/2026. The deadline for joining additional parties and amending the pleadings as of right is 12/11/2026. As discussed on the record, the Court refrained from setting additional discovery deadlines at this time given the parties' interest in pursuing mediation to resolve the case.
