OPINION AND ORDER. Defendants' motion to dismiss Surge's Complaint 45 is GRANTED in part and DENIED in part. It is GRANTED as to the following claims, and they are therefore DISMISSED without prejudice: The claims for misappropriation of trade secrets under the GTSA and DTSA, brought against Defendants Whitehead and Stevens; The breach-of-contract claims against the Individual Defendants based on the non-competition covenants of the Employment Agreements; The tortious interfer ence claims against Wise based on the non-competition covenants of the Employment Agreements; and The unjust enrichment claim against Wise. The motion to dismiss is DENIED as to the remaining claims. Additionally, the motion to seal 46 is GRANTED , and Surge is ORDERED, within 14 days of this Order, to comply with the instructions as to sealing contained in this Order. Defendants shall file their Answer to the surviving portions of the Complaint within 14 days of this Order. The parties' Joint Preliminary Report and Discovery Plan must be filed within 30 days of Defendants' Answer. The Clerk is DIRECTED to submit this Order to undersigned after 60 days.
