Order Order Staying Case
ORAL ORDER: Having reviewed Defendants' Motion to Arbitrate or in the Alternative to Transfer (D.I. 27 ) and the associated briefing, IT IS ORDERED that the motion is GRANTED insofar as it requests an order compelling arbitration. The named Plaintiffs do not dispute that they each signed valid, enforceable arbitration agreements; however, they argue that Defendants waived their contractual right to arbitrate. Having examined the docket in this matter, as well as in the related Williams litigation (No. 22-21023-KMM (S.D. Fla.)), the Court is unpersuaded that Defendants' conduct amounts to a waiver of its right to enforce the parties' arbitration agreement here. The record reflects little litigation activity in this case or in Florida, and Defendants referenced their right to compel arbitration in their pleadings in both cases. (See D.I. 12 , 18 ; see also No. 22-21023-KMM (S.D. Fla.), D.I. 36, 41.) While the docket in the Florida case reflects that Defendants were prepared to participate in a mediation facilitated by that court, that mediation never occurred (because Plaintiffs requested dismissal to avoid appearing in person in Florida). (See No. 22-21023-KMM (S.D. Fla.), D.I. 91, 93.) IT IS FURTHER ORDERED that this case is STAYED pending arbitration. Should arbitration not be pursued within 30 days, Defendants may move to lift the stay and dismiss the case. Ordered by Judge Jennifer L. Hall on 5/17/2024. (ceg)
