   ORAL ORDER re 16 Emergency Motion for Preliminary Injunction. IT IS ORDERED that Plaintiff’s emergency motion for a preliminary injunction is DENIED without prejudice to renew after service of the complaint on Defendant. This court generally only issues a preliminary injunction upon notice to the adverse party. Fed. R. Civ. P. 65(a)(1). Although a temporary restraining order may be issued without written or oral notice to the defendant or its counsel, Plaintiff must first provide “specific facts in an affidavit or verified complaint [which] clearly show that immediate and irreparable injury, loss, or damage will result to [him] before [the defendant] can be heard in opposition.” Fed. R. Civ. P. 65(b)(1)(A). Plaintiff must also “certify in writing any efforts made to give notice and the reasons why it should not be required.” Fed. R. Civ. P. 65(b)(1)(B). Defendant has not been served in this case, and Plaintiff has not provided a certification of efforts undertaken to inform Defendant of the motion or the reasons why service of the motion should not be required. For the reasons set forth in the Report and Recommendation dated August 4, 2026, Plaintiff’s allegations are insufficient to satisfy the standard for a preliminary injunction.
