MINUTES (IN CHAMBERS) by Judge Mark C. Scarsi: 28 ORDER RE: MOTION FOR LEAVE TO AMEND AND REMAND 28 . Plaintiff Brandon Sanchez moves to amend his complaint to add a new, nondiverse defendant. (Mot., ECF No. 28.) Defendant The Sherwin Williams Manufacturing Company (sued as The Sherwin-Williams Company) ("SherwinWilliams") filed a statement of non-opposition to the motion. (Statement of NonOpp 'n, ECF No. 30.) The Court vacated the hearing on the motion and deems the motion appropriate for decision without oral argument. The Court grants the motion. The Court deems Plaintiffs proposed amendedcomplaint, attached as Exhibit E to counsels declaration in support of the motion and docketed at ECF No. 28-6, the operative pleading in this matter. Pursuant to 28 U.S.C. § 1447(e), the Court remands the action to the Riverside County Superior Court, No. CVRI2601638. The Court directs the Clerk to effect the remand immediately and close the case (SEE FOOTNOTE 1: 1 Plaintiff alternatively asks the Court to substitute Partners Personnel for Doe 1 inthe original complaint. (Mot. 4, 10, 15.) Because the Court grants Plaintiff leave to file the proposed amended complaint, the Court denies the alternative request as moot."). (lc)
