Minute Entry for proceedings held before Magistrate Judge Andrew E. Krause: Status Conference held on 10/2/2026. Isaac Raisner and Jack Raisner appeared in person on behalf of Plaintiff. Richard Diorio appeared in person on behalf of Defendant. The Court addressed the discovery disputes raised in the letter filed at ECF No. 57. The Court ordered that the Netanel deposition may proceed without being limited to the scope of the matters set forth in the Netanel declaration. The time to take the Netanel deposition is extended to 10/16/2026. By no later than 10/19/2026, the parties are to file a letter addressed to Judge Krause, confirming that all discovery has been completed, and if it has not been completed, then explaining why not. As discussed at the conference, Plaintiffs counsel is directed to provide the one email with Netanel for the Courts in camera review. Adjourned. (Court Reporter Courtflow) (sbr)
Order
ORDER Based on the Court's review of the letter submitted yesterday (ECF No. 57) and the declaration that was just provided to the Court via email at the Court's request, the Court is not prepared to rule at this time that the deposition of Mr. Netanel should be limited to questions about the declaration. While the Court wants to give the parties the opportunity to offer further arguments at the conference on Friday, October 2, before making a final determination, the information provided thus far suggests that a broader deposition should be allowed. The Court's understanding is that the parties only wanted to proceed with the deposition tomorrow, October 1, if the deposition was definitely going to be limited; accordingly, it seems that the deposition should not proceed tomorrow.
